Secretary of State Karen Handel will appeal a Fulton County Superior Court Judge's ruling that Democratic PSC Candidate Jim Powell may remain on the November ballot.  The Supreme Court will now hear the case after the lower court overturned Handel's initial narrow ruling that removed Powell from the ballot.  Powell received 85% of the vote in the Democratic primary.  Handel's initial ruling used a narrow and new interpretation of Georgia law to overturn the findings of an administrative law judge she had initially referred the case to.  Both the administrative law judge and superior court judge found Powell eligible.
